Acceptable Use Policy

  1. Introduction
    Konexus is a Software-as-a-Service (SaaS) solution that provides emergency mass notification and critical event management services to its users. This Acceptable Use Policy (AUP) outlines the rules and guidelines governing the use of Konexus by its clients. By accessing or using Konexus, the client agrees to comply with this AUP and all applicable laws and regulations. Failure to adhere to this policy may result in the termination of the client’s Konexus account and legal actions.

  2. General Terms

    2.1. Konexus’ services are intended solely for use in emergency mass notification and critical event management. Users are not allowed to use the platform for any unlawful, harmful, or malicious activities.

    2.2. Client must ensure that only authorized personnel have access to a Konexus administrator account, and it is their responsibility to maintain the confidentiality and security of such login credentials. If a Konexus administrator account is compromised, it is the client’s responsibility to immediately inform Konexus.

    2.3. All outgoing content is the client’s sole responsibility, including the integrity and quality of the content. The client shall be responsible for any loss, damage or liability arising out of any content, including mistakes contained in the content, or the use of or subject matter of the content. 

    2.4. Client will not send any SMS (“short message service”) to a recipient unless a client has obtained such user’s “opt-in” consent.

    2.5. In the event that "Emergency Telephone Notification" (ETN) is used for emergency alerting to the public, FCC regulations apply, because the recipients have not previously explicitly opted in to receive voice calls. If sending any ETN alert, the client agrees that the calls will be necessary to notify the public of a critical situation affecting health and safety of the public.

    2.6. Client acknowledges that alerts may not be delivered to a recipient’s phone if the receiving phone is not in range of a phone transmission site, or if sufficient network capacity is not available at time of sending. Factors beyond the control of a phone carrier may interfere with delivery, even when a recipient is within a coverage area, including but not limited to: receiving equipment, weather, proximity to buildings, terrain and foliage.

  3. Prohibited Activities

    3.1. Unauthorized Access: Client shall not attempt to gain unauthorized access to Konexus, other users' accounts, or any systems, networks, or data connected or related to the service.

    3.2. Illegal or Harmful Content: Client may not use Konexus to transmit, store, or distribute any illegal, harmful, fraudulent, obscene, or offensive content. Client will not engage or facilitate any unethical, deceptive or misleading practices in connection with the use of the service.

    3.3. Spam and Unsolicited Communication: The use of Konexus for spamming, sending unsolicited messages, or for any form of phishing or scam is strictly prohibited. Client will not send any SMS (“short message service”) to a recipient unless a client has obtained such user’s “opt-in” consent.

    3.4. Malware and Hacking: Activities related to hacking, distributing malware, or any other attempts to compromise the security and integrity of Konexus or its users' data are not allowed.

    3.5. Impersonation: Client or any authorized users of the client must not impersonate any person or entity or misrepresent their affiliation with any person or entity while using Konexus.

    3.6. Abuse of Resources: Users are not allowed to engage in any activity that may overload, disrupt, or harm the performance of Konexus or its infrastructure.

    3.7. Violation of Privacy: Use of Konexus to violate the privacy of individuals, including the collection, storage, or dissemination of personal information without proper consent is strictly prohibited. 

    3.8. Probing or Vulnerability Testing: Any attempt to probe, scan or test the vulnerability of any part of the Konexus system or any attempt to breach security or authentication measures without Konexus’ express written consent is prohibited.

  4. Data Usage and Storage

    4.1. Konexus collects and stores user data for the purpose of providing its services. By using the platform, the client consents to the collection, processing, and storage of their data as outlined in the Privacy Policy.

    4.2. Client is responsible for ensuring that the data uploaded to Konexus complies with all applicable data protection and privacy laws.

    4.3. Konexus reserves the right to delete or remove any data that violates this AUP or poses a security risk.

  5. Reporting Violations
    If a client or authorized user becomes aware of any violation of this AUP or suspects any unauthorized use of Konexus, please promptly report it to tickets@konexus.com.

  6. Consequences of Non-Compliance

    6.1. In the event of a suspected violation of this AUP, Konexus may investigate the matter and take appropriate actions, including account suspension or termination.

    6.2. Konexus may also cooperate with legal authorities and provide them with any necessary information in cases of suspected unlawful activities.

  7. Modifications to the AUP
    Konexus reserves the right to update or modify this AUP at any time without prior notice. 

 

By using Konexus, the client acknowledges that they have read, understood, and agree to abide by this Acceptable Use Policy. Violation of this AUP may result in the termination of the client’s Konexus account and potential legal consequences.
